ABJ: Constitutionality of state law that allows developers to deannex land challenged in court

Published Tue, 04 Mar 2025 07:25:54 GMT

AUSTIN (Austin Business Journal) -- As disagreements between cities and landowners over a new state law wage on, one Texas city is taking its complaints to court, and an Austin-area municipality is joining the fight. This marks the latest pushback of Senate Bill 2038, which was passed earlier this year by the Texas Legislature and went into effect on Sept. 1 after Gov. Greg Abbott signed it into law. The law essentially allows landowners on the fringes of major cities to petition to be removed from an extraterritorial jurisdiction, freeing them up to develop with fewer regulations. Many in the business community have said SB 2038 makes development easier in rapidly growing areas near big cities and helps to keep up with housing demand, although most agree deannexation should be a last resort. Opponents said the law is too friendly to developers and limits cities' power to effectively regulate land they might one day annex. Court and lawyer fees are starting to pile up as more landowne...

Published Tue, 04 Mar 2025 07:25:54 GMT

Even today, people are judged not by the value they add but by the color of their skin. As racism persists in a place known to be called “The Land of the Free,” we have to ask ourselves, “Are we really free?”In 2020, we saw the world chanting “I can’t breathe” for an innocent Black man whose demise was among the countless lives that were suffocated, stripped of their voice just because of their appearance. The George Floyd protests were rare occasions when people worldwide united against the forces of hate, giving us hope that maybe there is a brighter tomorrow. However, how do we ensure our voices impact future generations?Without knowledge, there is no power. We must first examine and research America’s history of racial inequality before we pursue fighting to regain what we have lost for reparations. And helping us achieve just that, there is a man who presents a guide for anyone wishing to step forward with strength and bravery to he...
